Introductory

 

The following Rules and Regulations constitute an agreement between yourself and Fortuna Universal (operators of Cabaret Casino Online). It is important that you read them carefully and understand what they mean. By registering and choosing to play any of the games provided by Fortuna Universal at this or any other site operated by that company, you signal your complete acceptance of these terms and conditions and your full understanding of them.

 

You must be over 18 to take part. You must satisfy yourself that by taking part you are not violating the laws of the country where you reside or of which you are a citizen.

 

Fortuna Universal is authorised and licensed by the Government of Costa Rica to conduct gaming via the Internet pursuant to licence N 3-101-247165

 

1.0   Unless the context otherwise requires, the use of the singular includes the plural and the use of the masculine includes the feminine.

1.1   The English Language version of these Terms and Conditions shall prevail in the event of any discrepancy between the meaning of that version and a version in ANY other language.

 

Ineligible Persons

2.0   No person who is under the age of 18 years may play any of the games provided. No person may play on behalf of a person who is under the age of 18 or pay for such a person to play.

2.1   Players must also satisfy themselves that it is lawful for them to play according to the local laws of the State of which they are citizens and/or the State in which they reside and/or in which they happen to be at the time they register to play. Neither Fortuna Universal , its servants or agents shall be taken to make any representations, express or implied, as to the lawfulness of any player's participation.

2.2   Residents of Costa Rica, France, Canada and the USA may not play.

 

Participation

3.0   Fortuna Universal reserves the right to refuse to allow any person to play without giving any reason for so refusing.

3.1   Players may not play unless and until any payments made by them have been authorised by the source of the payment.

3.2   In the event that any payment which has been authorised in accordance with Rule 3.2 above should be dishonoured in any way, any games played by the player by or on whose behalf the payment is made shall be null and void and any winnings to which he might otherwise be entitled shall not be payable. Fortuna Universal further reserves the right disqualify that player from future participation in any of its games.

3.3   In the event of any alleged discrepancy between the data which a  participant alleges that he has provided to Fortuna Universal, the record of the data as it appears in the database maintained by Fortuna Universal shall prevail. It is the responsibility of the player to check and where appropriate confirm that any information which he has submits   correct at the time of submission.

3.4   Fortuna Universal reserves the right to treat any data received from a player which is incomplete and/or corrupted in any way as invalid. In the event that any such data relates to a player's participation in any game, that participation shall be deemed to be null and void and his stake(s) in respect of that game shall be repaid to him.

3.5   Players must play as individuals. In the event that persons are found to be playing as part of a professional syndicate their participation shall be null and void. In the event that a player is suspected of  entering as part of any such syndicate, it shall be for him to prove that he was entering as an individual. The decision of Fortuna Universal on the matter shall be final.

 

Payment of Winnings

4.0   Funds for the payment of winnings will be held to the account of Fortuna Universal. The said funds will be audited by Fortuna Universal's accountants and auditors.

4.1   Players may elect to have their winnings paid by a variety of methods. Players may experience a slight delay in the processing and payment of their winnings.

 

FREE $30: Real money players only

5.0   Fortuna Universal may, at its sole discretion ban a client from entering the casino and refuse payment if the client fails to conform to the official rules of this site or it appears to Fortuna Universal that the client is abusing the free $30 Promotion.

 

Confidentiality

6.0   Personal information about a player including any details of his winnings or losses will remain confidential unless that player consents in writing to the disclosure of that information. This shall not apply in the event that the disclosure is ordered by any court of competent jurisdiction. If a player is a citizen of, or lives in a jurisdiction where winnings are taxable, it is his responsibility to declare his winnings to the appropriate authorities in that jurisdiction.

 

Suspension or Cancellation of Games

7.0   Fortuna Universal shall have complete discretion to suspend or cancel any game without giving any reasons.

 

Exclusion and Limitation of Liability

8.0   Fortuna Universal will not be liable to any person for any loss or damage occasioned by:

(i) force majure, act of God, outbreak of riot, civil disturbance, insurrection, act of terrorism, act of any government or authority (including the refusal, revocation or cancellation of any licence consent or permission), fire, explosion, theft, malicious damage, strike, lock-out or industrial action of any kind;

(ii)  the failure of all or any part of Fortuna Universal's computer and/or record keeping systems;

(iii)  the failure of any telecommunications, broadcasting or other data transmission system;

(iv) the interception of a player's credit card or other financial details and/or the misuse thereof

(v) any third party claims against players.

8.1   Without prejudice to any of the Rules above, any liability of Fortuna Universal to any player shall be limited to United States $ 100

 

Disputes

9.0   The relationship between the parties as well as this agreement shall be governed exclusively by, and construed in accordance with, the laws of Costa Rica whose courts shall have sole jurisdiction.

9.1   In the event of any dispute regarding a player’ alleged entitlement to receive any winnings, the decision of Fortuna Universal will be final and binding in all respects.

 

General

10.0   By registering to participate in any games a player represents

(i) that he has understood these Rules and/or any version amended or varied in accordance with Rule 10.2 below thereof and accepts them;

(ii) that he is over the age of 18 years;

(iii) that his participation in the Draw is not prohibited by the local laws of the State where he resides, or of which he is a citizen or where he happens for the time being to be;

10.1   In the event that a player's participation in any Draw is prohibited by any of the local laws referred to in Rule 10.0 (iii) above, the player warrants that he shall be solely responsible for any violations of those laws and shall hold Fortuna Universal, its officers, directors, servants, agents, sub-agents and media partners harmless from any and all liabilities, damages, legal costs and expenses whatsoever arising in consequence of his use or re-use of the Website of Fortuna Universal and/or his participation in any Draw and/or his acceptance of any prize.

10.2   Fortuna Universal reserves the right to amend and/or vary these Terms and Conditions without prior notice.
